This Terms and Service Agreement ("Agreement") is a legal agreement between you, the user ("User" or "you"), and Proudly Shirted ("Company" or "we"), governing your use of the e-commerce store ("Store") operated by Proudly Shirted, accessible at www.proudlyshirted.com. 3. Order Placement and Acceptance
By placing an order through the Store, you are making an offer to purchase the selected Products under the terms and conditions of this Agreement. We reserve the right to accept or reject any order in our sole discretion. Upon order placement, you will receive an order confirmation email, which does not signify our acceptance of your order. The acceptance of your order occurs when we dispatch the Products to you and send a shipping confirmation email.
4. Custom Design Submissions
If you submit custom designs to be printed on the t-shirts, you represent and warrant that you have the necessary rights, permissions, and licenses to use and reproduce the designs. We reserve the right to reject any design that violates copyrights, trademarks, or any applicable laws. By submitting a custom design, you grant us a non-exclusive, royalty-free, worldwide license to reproduce, modify, and distribute the design solely for the purpose of fulfilling your order.
5. Pricing and Payment
The prices listed on the Store are in the currency specified and are exclusive of any applicable taxes, duties, or shipping charges. You are responsible for paying all such charges as applicable. We accept payment through the provided payment methods and use secure payment gateways. Prices and availability of Products are subject to change without prior notice.
6. Shipping and Delivery
We will make reasonable efforts to ensure timely delivery of the Products. However, we are not responsible for any delays or damages that may occur during shipping or delivery. Risk of loss and title for the Products pass to you upon delivery. Please refer to our Shipping Policy for more details.
7. Returns and Refunds
We strive to ensure your satisfaction with our Products. If you receive a defective or incorrect Product, please contact us within 30 days of the delivery date to arrange for a return or exchange. 10. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the state of Pennsylvania, United States. Any disputes arising out of or in connection with this Agreement shall be resolved through good faith negotiations. If any dispute cannot be resolved amicably, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association in Glen Mills, Pennsylvania.
11. Amendments and Updates
We reserve the right to modify or update this Agreement at any time without prior notice. Any changes will be effective immediately upon posting on the Store. Your continued use of the Store after the posting of changes constitutes your acceptance of the modified Agreement.
12. Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
